SEOUL, S.KOREA, June 24, 2011 - (ACN Newswire) - Suprema Inc., a leading provider of biometrics solution, announced that the company got a favorable ruling from the Initial Determination by the Administrative Law Judge (ALJ) of the USITC (U.S. International Trade Commission) in the patent litigation against Cross Match Technologies.
On June 17, 2011, the ALJ of the USITC issued an Initial Determination ruling that (i) Suprema's RealScan products do not infringe any asserted claim of U.S. Patent No. 7,277,562 (what Cross Match widely advertises as its "auto-capture" patent); (ii) Suprema's RealScan products used with the company's RealScan SDK do not infringe asserted claims 1, 7, 41, 42, 43, and 45 of U.S. Patent No. 7,203,344 (the '344 patent); and that (iii) Suprema's Realscan-D and Realscan-F do not infringe any asserted claim of Cross Match's U.S. Patent No. 5,900,993 (the '993 patent). In addition, earlier in the ITC investigation, Cross Match had voluntarily withdrawn U.S. Patent No. 6,483,932.
According to the Initial Determination, there is no finding of infringement as to Suprema's newer-generation live scanners, RealScan-G2, RealScan-G10, and RealScan-F. While the ALJ ruled that one claim of the '344 patent is infringed by RealScan-10 and RealScan-D when used with Mentalix's Fed Submit software, and that Realscan-10 infringes the '993 patent, Suprema strongly disagrees with such ruling and will petition the USITC to review the ALJ's Initial Determination. This Initial Determination is a preliminary decision by the ALJ subject to review by the USITC for Final Determination.
The ruling by the Initial Determination is not expected to adversely affect Suprema's live scanner business in the United States as there is no finding of infringement as to either Suprema's software or its newer-generation live scanners. Suprema further assures its customers that any ruling from the USITC is limited to the United States and will have no legal effect on Suprema's live scanner business outside the United States.
Suprema's live scanners have been chosen for several worldwide civil and criminal ID projects in the United States, India, Brazil and other countries.
