SEOUL, S.KOREA, Oct 28, 2011 - (ACN Newswire) - Suprema Inc., a leading biometrics solution provider, announced that the company has received a favorable Final Determination by the USITC (U.S. International Trade Commission) on the patent infringement complaint brought by Cross Match Technologies. Following an Initial Determination issued by the Administrative Law Judge on June 17, 2011, the USITC issued its Final Determination on October 24, 2011, clarifying the previous Initial Determination that Suprema does not infringe U.S. Patent No. 7,277,562 (the '562 patent), does not directly or contributorily infringe any claim of U.S. Patent No. 7,203,344 (the '344 patent), and that Suprema's RealScan products and SDK do not by themselves infringe claim 19 of the '344 patent.
While the Commission also ruled that Suprema infringed certain claims of U.S. Patent No. 5,900,993, and induced infringement of claim 19 of the '344 patent when used with Mentalix's Fed Submit software, the Commission's Final Determination affects Suprema's previous live scanner model only. As there is no finding of infringement as to either Suprema's software or its newer-generation live scanners, the ruling by the USITC's Final Determination is not expected to have a materially adverse effect on Suprema's live scanner business in the United States. Suprema further assures its customers that any ruling from the USITC is limited to the United States only and will have no legal effect on Suprema's live scanner business outside the United States.
